Township solicitor Heinhold reported that the township filed a verified complaint with an order to show cause last Friday seeking removal of an operator at 2407 Burlington Avenue unless they obtain proper approvals. Heinhold told the committee the action follows months of occupation, multiple land-use delays and alleged code and environmental violations.
"We filed that action. It's a verified complaint with an order to show cause," the solicitor said, adding that the property faces potential fines under the Uniform Construction Code and construction-code violations, board-of-health matters and NJDEP violations related to spills and unapproved activity on unpaved portions of the site. Heinhold said the land-use application had been delayed several times and was ultimately dismissed without prejudice after the applicant again failed to proceed.
Heinhold told the committee his office would update the governing body as court dates are set and cautioned that litigation is costly and undertaken only when the township believes it has a significant case. He said a hearing date before the court was expected later in August.
