Community Development Director Don Ferguson provided several administrative and legal updates to the commission at the Aug. 28 meeting.
Ferguson said the city received a favorable decision in litigation over a McDonald's application: "we did receive a decision on the McDonald's lawsuit... the district judge ruled in favor of the city finding that, there was competent evidence to support council's denial," he reported. He also told commissioners that the Ridge Golf Course withdrew a prior variance application to exceed parking maxima and has submitted a new site plan application that stays within permitted parking amounts.
Ferguson reminded the commission that state law and recent regional work require a local housing needs assessment; staff indicated the city may use the Denver Regional Council of Governments' regional assessment to satisfy the state requirement if presented and commented to the council within the prescribed timeframe. He also invited commissioners to a light‑rail groundbreaking ceremony next Wednesday and explained the schedule for upcoming planning commission meetings through the end of the year.
