Council approves Phase 3 watermain extension; attorney says contractor responsibility not yet determined

After questioning whether the contractor should pay for schedule delays on the Phase 3 watermain project, the council approved MSA Amendment #1; MSA's Jared Fluhr said delays are common, and the city attorney advised the council the current amendment relates to the contract with MSA, not with the on-site contractor.
On Old Business the Council considered MSA Amendment #1, an extension to the Phase 3 watermain project schedule. Alderman Mike Risko asked whether Law Excavating’s absence on site should make the contractor responsible for the extension. Jared Fluhr of MSA replied, "every project runs behind schedule for many reasons, weather or equipment and supply issues." City Attorney Zollinger told the Council that the amendment pertains to the city's contract with MSA and that any determination of contractor responsibility would come later when the project closes: "this contract has nothing to do with the contractor at this point."
Alderman Risko moved to approve the extension and Alderman Soenksen seconded; the motion passed on a roll call vote with five yeses and one absence. The Council did not assign financial responsibility to the on-site contractor during this meeting and deferred any such determination to project close-out procedures.
