Contractor withdraws from Smithville commercial sidewalk project; city to meet with MoDOT and bond company

City staff told the Smithville Board that Legacy Underground, the contractor on the commercial sidewalk project, has informed the city it is shutting down and cannot complete the work. Myra, the staff member handling the project update, said staff had received an official letter and had already arranged meetings with MoDOT and the bond company to plan next steps.
"They will be shutting down the company. Therefore, they won't be able to complete the job," Myra said, and added that staff will prioritize completing the area around the school. She said the city is exploring whether the second-low bidder, Amino Brothers, will accept the prior bid amount; if so, the bond company would be responsible for any difference. If not, the city will continue down the bidder list or re-bid the work.
Myra also noted the sidewalk contract is administered by MoDOT because the project uses federal funding from the Federal Highway Administration; she said the city must follow MoDOT rules for administering the project. City staff indicated more details would be shared after a scheduled meeting with state officials and the contractor.
