County to set public hearing on 2024 International Code; commissioners discuss possible delay until new commission sworn

Staff told the commission it will place an item on the BOCC regular agenda to set a public hearing for adoption of the 2024 International Code; the hearing was proposed for Jan. 8, but Fire Marshal Chris said that date is flexible and primarily chosen to align with other municipalities.
One commissioner raised the possibility that substantive issues could appear during the public hearing and suggested pausing adoption until the newly seated commissioners are sworn in. Fire Marshal Chris said extensive due diligence had been completed and he did not expect parties to "come and try to throw a wrinkle" into the process, but he acknowledged the scenario could occur. Legal counsel explained that the Board of County Commissioners sitting with home-rule powers (rather than the fire district governing body) must adopt the county fire code for it to be enforceable.
Staff will brief the commission next week with the proposed code language and the fire marshal will be available at that briefing; commissioners said they will review the materials and could postpone the hearing if they identify substantive items that require more time.
