Board approves deck replacement variance at Spirit Lake property

Homeowners Ken and Kim Griffith told the Dickinson County Board of Adjustment they purchased a home with an existing 11-foot deck and want to replace and extend it because the stairs are deteriorating and family members have fallen. Ken Griffith explained the deck was built under an earlier setback regime and the family seeks a safety improvement that would move the deck roughly 3 feet outward and add a gate at the top.
“there was an 11-foot deck on the home when they purchased it and the setback at the time was 34 feet,” the Griffiths said. Neighbor David Kitzinger spoke in favor of the variance. Alex Oponski moved to grant a front-yard setback of 31 feet where 40 feet is required (a 9-foot variance) and to add a safety gate; Westerman seconded and the board approved 5–0.
