Board approves side-yard variance for Lucas family at 15509 250th Ave

The Dickinson County Board of Adjustment on May 26 unanimously approved a side-yard variance for Dan and Janet Lucas at 15509 250th Ave.
The Lucases said they had previously asked City of Orleans staff whether a variance was needed and had been told none was required; county staff later notified them that a variance was necessary because a neighbor had complained. Dan Lucas said the egress is intended for grandchildren and family visiting the property. Neighbor Sharon Maassen told the board she had no objection to the egress window: “she had no problem for the egress window to stay.”
Board member Kirby Berhow moved to grant a 2-foot side yard where 5 feet is required (a 3-foot variance); Westerman seconded and the motion passed 5–0. Planning staff said they would follow up on a separate fence permit issue mentioned by a neighbor.
