Commission grants 9-foot fence variance for homeowner after repeated trespassing

The commission voted unanimously to approve a variance permitting a rear-yard fence up to nine feet tall for the property at 7821 Beachview Drive after the homeowner, Thomas Rodriguez, reported six trespassing incidents captured on home surveillance cameras.
Planner Craig Pinder described the existing conditions, including an aluminum fence placed without permit and parts of the proposed work that would intrude onto FDOT right-of-way. Rodriguez said the intrusions happened multiple times and that the increased height was necessary to reduce the risk. "I have records of four times on camera and another two times missing things in my backyard," Rodriguez said. The commission approved the variance with conditions that any work on FDOT property requires authorization and that improvements must comply with village and FDOT discretion.
