The Raleigh County Commission approved a temporary right-of-entry and access agreement to permit county staff and contractors to access the Deep Creek Sewer Benefit District lagoon for necessary maintenance. Jacob Hance, who presented the item, said negotiations with property owners avoided an eminent-domain action for now and the agreement will allow access while a permanent easement is drafted.
"We have this temporary right of access agreement, which will just work, to, well, give us temporary access until we have a permanent easement description," Hance told the board. Commissioners moved and seconded the agreement and voted in favor. The chair was directed to sign the agreement.
Hance said the temporary agreement is intended as an interim measure to maintain sewer operations; staff will return with a permanent easement description once surveys and legal descriptions are complete.
