Planning Commission finds zoning map error, affirms industrial zoning for 2408 S. Long Lake Road

The Fenton Planning Commission voted April 23 to affirm that a parcel at 2408 S. Long Lake Road was shown incorrectly on the city zoning map and should remain designated industrial, removing the need for a rezoning hearing. OHM Advisor Justin Sprague told commissioners that assessor records and prior lot-split documentation show the parcel was zoned industrial prior to a 2018 split and that the apparent Rural Density Residential (RDR) label on the map resulted from an error.
"We have NO RECORD of a formal Public Hearing at the Planning Commission nor a decision by the City Council," Sprague said, describing the discrepancy found in historical records. Building Official Jason Payne concurred with the interpretation. Commissioner Rossmaessler moved to accept the advisors’ interpretation and to correct the zoning map; the motion passed 6–0.
The commission’s action removes the need for a rezoning process in this case but requires staff to correct the official zoning map so that records match assessor data. The correction still leaves in place required public hearings and approvals for any site-specific special land use or site plan applications tied to the parcel.
