Staff: Piedmont will allow conversion of uncovered parking to ADUs under new state law

Planning staff told the commission that SB 1211 requires cities to permit conversion of uncovered parking spaces to accessory dwelling units and prohibits locally-imposed replacement-parking requirements for such conversions.
"The updates proposed ... implement SB 1211 by allowing an uncovered parking space to be used or converted to an ADU slash JADU," Associate Planner Gopika Nair said, explaining staff's draft amendments to the city's parking regulations. She added that the proposed language is consistent with current rules for covered parking conversions, meaning replacement parking would not be required for converted uncovered spaces.
Commissioners asked whether driveway areas commonly used for parking would be included. Staff replied that driveway spaces can be converted if an ADU would be created in that location and emphasized the need to clarify zoning applicability. Commissioners noted potential neighborhood parking impacts and asked staff to add public-facing guidance about what residents should expect when permits are filed.
Staff said they will add clarifying information to the city website and permit checklists to help neighbors understand when driveway conversions could be permitted.
