Spring Branch ISD board upholds Level II finding in Level III FNG complaint by Rummel Creek parent

Board President Shannon Mahan opened the special meeting at 5:00 p.m., certified compliance with the Texas Open Meetings Act and the public-notice requirement, and confirmed a seven-member quorum. She noted the parent had asked that the hearing be held in open session. Trustees in turn stated on the record that they could be impartial for the hearing. "President Mahan certified that the provisions of the Texas Open Meetings Act, Texas Government Code Section 551.041, had been complied with in connection with public notice of the meeting," the record states.
The parent identified in the agenda as E. Roth presented the parent's case to the board in the allotted 15-minute presentation. Ellen Spalding of the SNLL Law Firm, representing district administration, then presented the administration's response during its allotted 15 minutes. The board recorded that no members of the public had signed up to speak during the public-comment portion of the meeting.
At 5:27 p.m. President Mahan recessed the board into executive session under Texas Government Code sections 551.071 (consultation with counsel), 551.0821 (deliberation regarding personally identifiable information of public school students), and 551.074 (to hear a complaint or charge against a public-school officer or employee). The board reconvened in open session at 5:52 p.m.; the meeting record states that no action was taken while in closed session.
Following reconvening, "Motion was made by Trustee Chris Earnest and seconded by Trustee Jennifer Hyland to uphold the Level II decision." The motion carried on a 7-0 vote with Trustees Walker Agnew Jr., Courtney Anderson, Caroline H. Bennett, Chris Earnest, Jennifer Hyland, Shannon Mahan and David Slattery recorded as voting yes. President Mahan adjourned the meeting at 5:53 p.m.
