Staff explained that Verona's 1.5-mile extraterritorial planning authority allows the city to review land divisions, but Dane County retains zoning authority. Staff said the applicant agreed to dedicate additional right-of-way along Range Trail to make the roadway consistent with planned future construction. Commissioners discussed whether approval should be conditioned on a separate Dane County zoning change; staff and commissioners concluded the CSM could proceed independently and that zoning for building another home would still require Dane County action.
Applicant Michael Johnson told the commission, "Our intention is to not split the lot," and said he intends to build a single-family home on the property. Commissioners raised the possibility of deed restrictions to prevent future subdivision; staff said they are consulting with the city attorney and that a deed restriction may be outside the city's authority in this context. The commission recommended approval with packet conditions; the motion passed 3–0 with the Chair abstaining.
The recommendation will move to the Common Council; any future construction that requires zoning changes will require Dane County action and separate review.
