The board found the lot contains pre‑existing nonconformities: the existing lot area is 5,837.40 sq. ft. where the zoning minimum is 6,000 sq. ft., and lot width is 41.40 ft. where 50 ft. is required. Solicitor Alena Hyatt confirmed the board had jurisdiction and the motion to approve (moved by Darlene Vondran, seconded by T. Saban) passed with recorded ayes from Abate, DePoe, Miller, B. Saban, T. Saban, Simon, Vondran, Wiseburn, Swartz and Amer.
Applicant attorney John Alice described the project and referenced a tax map and elevation exhibit; he said a similar home under construction on adjacent Lot 11 will be about 1,675 sq. ft. of living space and was being marketed in the "$400,000.00 range." The board required a grading plan as a condition of approval and recommended the Resolution include follow‑up regarding a neighboring pool pump discharge; the board opened and closed the public comment period and recorded no objections to the variances.
