The North Caldwell Zoning Board required the applicant for 356 Central Avenue to remove a portion of a stone driveway that extends beyond the property line as a condition of approving the renovation on Feb. 11. The board also required the applicant to maintain a 10-foot setback for air-conditioning units in accordance with Borough Code and capped maximum lot coverage at 31.36%.
Board Engineer Candice Davis flagged an existing driveway encroachment and the board recorded an approximate 11 square feet of impervious surface included in the lot-coverage calculation; the board directed the applicant to remove that encroaching driveway area. During testimony, the applicant and the board agreed to record a 13.9-foot side-yard measurement for variance purposes. The board’s motion specified that the front stoop must not encroach further than the existing 48.5 feet into the front setback and that the applicants "remove the portion of driveway that extends beyond the property line." The motion carried unanimously, 6-0.
The board noted the house was constructed in 1978 and that the property’s nonconforming elements likely predate current ordinance limits. Compliance with the driveway removal and A/C setback will be verified by the zoning secretary/board engineer before any permits are issued.
