Legal counsel: CRA must adopt budget today or face legal and financial consequences

"The CRA is a dependent special district...you have an obligation under the law to adopt a budget today," she said, reading statutory language about appropriations and project funds.
Kimberly Vasquez, the CRA project manager, then reviewed a staff memo listing specific consequences if the budget failed: default on bond series in the East and Northwest districts, developer reimbursements that could not be paid (noting $300,000 to Sonata and $1,000,000 to the Mala project), monthly predevelopment payments such as $70,833 to Roca Point, and inability to pay insurance premiums after Oct. 1. "If we default on those bonds, it could lead into...we would have to notify the bond holders immediately," she said. The presentation framed the legal warning as a practical financial risk to both the CRA and city and helped push discussion toward compromise amendments and a final vote.
