Oakdale adopts smoke-shop permit fees to support enforcement and limit retailers

Staff presented the background for a smoke-shop regulatory program tied to Oakdale Municipal Code chapter 38 and an amendment to the tobacco retailer license limitation in chapter 16, citing increased juvenile use of tobacco and vaping products and a rising number of smoke-shop businesses. Staff recommended a fee schedule to support program administration and enforcement and said the city manager or designee will oversee implementation.
Staff detailed the proposed fees: a $500 nonrefundable application fee (applied to the first year if approved), an annual permit fee of $1,100 and a reinspection fee of $5.30 for follow-up inspections after a failed initial inspection. "Permit fees will help offset the costs incurred by the Oakdale Police Department for proper handling and disposal of seized vaping devices and cartridges," staff said. After brief council questions about grandfathering and reapplication timing, a motion to adopt the resolution passed by roll call, 4-0.
