"Based on the law outlined in the proposed order I propose the Commission find that the withdrawal was made without prejudice and as such to set the parties back to the state they were in when the docket was filed," Crano said, and recommended a time‑limited extension of the waiver to future ESA applications. The Commission accepted the hearing officer's recommendation and issued the proposed order on the record.
The action returns the parties to the status quo ante for that docket and preserves a time‑limited waiver for a future ESA application; no further conditions were added on the record during the public meeting.
