The hearing officer presented agenda item 3a and recommended the Commission adopt staff's proposed approach to implement requirements arising from Senate Bill 326 (2025) through annual water-utility report forms instead of promulgating new regulations.
The hearing officer said participants in the rulemaking agreed most information requested by SB 326 could be collected via the annual report process and that additional report-form questions had been negotiated among participants. One participant (Indian Springs Water Company) objected to part of a proposed second question; the recommended order adopts part of that question and instructs staff to add it to the water-utility annual report forms while rejecting the remainder. The Commission moved to accept the hearing officer's recommendations and voted unanimously to issue the appropriate order.
The hearing officer noted the docket opened on 07/01/2025. Commissioners praised the relatively swift completion of the rulemaking work and then adopted the order.
