Council approves sale ordinance and hires Max Spann to auction surplus property

The Ogdensburg Borough Council on Sept. 8 adopted Ordinance 09-2025 authorizing the sale of Borough-owned properties identified as Block 21 Lot 27 and Block 26.09 Lot 39. Mayor George P. Hutnick opened a public hearing on the ordinance; there were no public comments and the measure passed by roll-call vote (Yeas: Ciasullo, Cowdrick, DeMeo, Gandarinho, Lame, Ruitenberg).
Following adoption, the council approved Resolution 77-2025 to retain Max Spann R.E. & Auction Co. as broker and certified auctioneer to list, market and auction those properties under N.J.S.A. 40A:12-13. The contract term is six months and includes a 10% buyer’s premium added to the sales price and payable by the successful purchaser at closing. The resolution notes the contract award is contingent on receipt of Max Spann’s New Jersey Business Registration Certificate and statutorily mandated political-contribution forms. The resolution further states that the total value of acquisitions under the contract “may or may not exceed $17,500.00 depending upon the number and amount of successful bids received and approved by the Borough.”
Council reported that the Mayor and Clerk are authorized to execute the agreement, and the Borough Clerk will advertise and file the contract for public inspection.
