Montezuma County delays enforcement for property at 9506 Road 29.1, sets 45-day septic compliance deadline

A Montezuma County Board of County Commissioners hearing on an on-site wastewater treatment system (OWTS) for the property at 9506 Road 29.1 was continued 45 days to Sept. 15 to allow the owner time to remove extra recreational vehicles and complete septic permitting and installation.
Miss Hill, representing county public-health staff, said she conducted a site visit and found "no signs of gray or black water on the property," but confirmed the parcel is zoned as a subdivision and therefore requires a septic system. "So right now, it's not a public health risk," Miss Hill said, adding that one trailer is serviced and other waste is disposed of off-site.
The property owner, identified in the record as Miss Phillips, told the board she had "gotten a hold of a few people to get the process started" but cited limited finances as the principal barrier. "I'm not sure how long the process takes," Phillips said, and said she expected to make "a dent in it in 45 days, for sure."
Commissioner (motion maker) proposed continuing the matter to Sept. 15 and reviewing progress at that time. The motion to continue the OWTS hearing for 45 days was moved, seconded and approved by the board. The chair noted the continuation was intended to be "consistent and fair" with earlier timelines.
The continuation gives the owner time to pursue permits and installation and for county staff to confirm removal of noncompliant RVs. The board did not impose immediate enforcement action because staff reported no active public-health contamination at the time of inspection.
