The council advanced the first reading of an ordinance that would add chapter 21.30 to the Belvedere Municipal Code to permit property owners to apply to remove historic designation. Staff told the council that the ordinance creates a general, deliberative process for removal and a separate streamlined (ministerial) track for properties designated between 06/01/2021 and 05/01/2024 that are not participating in the Mills Act.
As staff described it, "This process ensures the removal decisions are deliberative, consistent, and equitable, balancing property owners' desires with the city's interest in protecting historically significant resources." Staff also explained the rationale for shifting the expedited-start date to 06/01/2021 so two properties that applied but could not receive Mills Act benefits because the city discontinued the Mills Act would be eligible for the streamlined path.
Council debate focused on whether an administratively approved streamlined exit was appropriate for some homes, what oversight would remain, and what fees to charge. One council member said, "I'm still not in favor of an expedited process," arguing that many of the homes had met most historic criteria and deserved the rigorous review. Other members said a short, time‑limited streamlined window with a fee and mayor sign‑off could be appropriate; council settled on adding a 90‑day streamlined application period, requiring a reason on the application form, adding mayor sign‑off to the staff signature and directing that fees be set in the city fee schedule as a separate resolution. The first reading passed by voice vote; the ordinance will return for a second reading and ordinance adoption on a future agenda.
