PDC advances TikTok/ByteDance enforcement matter to full commission meeting

Chair Hayward moved the TikTok/ByteDance matter out of the brief adjudicative track and scheduled it for the full commission on Dec. 12 to allow involvement of agency attorneys; the hearing will not be held today.
Counsel for TikTok, Rob Kellmer of Covington & Burling, appeared at the Oct. 29 brief adjudicative proceeding. Chair Allen Hayward announced he would exercise his authority to move the TikTok/ByteDance matter from the brief adjudicative track to the full commission docket.
Hayward said the next regular commission meeting is scheduled for Dec. 12 and that the case will be heard before the full commission at that meeting. Staff and the chair noted that taking the matter to the full commission will require involvement of Assistant Attorney Generals (AAGs) and that the case therefore may be calendared later than Dec. 12 if additional coordination is needed. "That is our plan to have this heard at the next commission meeting, which I believe is regularly scheduled for Dec. 12," the chair said.
The commission did not adjudicate the TikTok matter on Oct. 29; the case will be scheduled for presentation to the full commission with counsel and agency attorneys present.
