At a brief adjudicative proceeding Oct. 29, PDC staff told commissioners that candidate Lisa Malpass exceeded the 'mini' reporting thresholds before requesting conversion to full reporting and failed to timely file required C3 and C4 reports for the 2024 election cycle.
Tanya, the staff presenter, said the mini reporting option requires committees to stay under $7,000 in activity and to accept no more than $500 from a single contributor; she reported that Malpass's campaign exceeded the $7,000 threshold on July 1, 2024, and had $9,156.86 in reported activity by July 5, 2024 (including $2,173.91 in filing fees). The staff noted multiple July filings and amendments and stated the campaign was 100% self-funded. "The committee must agree to not raise or spend more than $7,000... Changing from the mini reporting option to the full reporting option requires PDC staff's approval," the presenter said.
Respondent Lisa Malpass testified she had submitted numerous amendments and could not account for an itemized $54 expense that rolled into August reporting and pushed the campaign over the mini threshold. The chair said the facts supported a violation but acknowledged mitigating factors; the commission found a violation and (in deliberations) the chair proposed — and the commission recorded — a civil penalty of $300 with $200 suspended, leaving $100 payable, and ordered the respondent to file outstanding reports within 30 days. Staff will provide payment instructions and monitor compliance.
