Board places conditions on easement encroachments and flags tree-planting risk to storm sewer

Engineering staff presented two easement encroachment requests: one for a fence and one for tree planting near a storm sewer. Staff recommended approving the fence request subject to three standard conditions and recommended caution or disapproval of the tree request because of prior instances where roots infiltrated pipe joints and blocked flows.
The engineer explained the condition proposed for the tree request: if tree roots later damage or block the storm sewer line, the property owner would be responsible for removing the trees and paying for any repairs. "If the tree root system happens to grow into and damage and or block the storm sewer line, the property owner will be responsible for removal of said trees and any cost for repairs to the storm sewer line," the engineer said while recommending conditions. The board approved the encroachment requests with the listed conditions and asked staff to retain documentation in the file.
