Planning Board issues SEQR negative declaration and approves Dolan Solar site plan with conditions

Representatives for Dolan Solar updated the board on screening, stormwater and permitting. "We have extended the 2 rows of evergreen trees adjacent to Moses Creek Farm to meet the existing tree line," said Evan Callahan, noting supplemental planting and proposed tree topping to meet screening goals. The applicant acknowledged the SWPPP is incomplete and said it will be finalized; the applicant also said it has submitted for a DEC wetland permit and will supply required documentation after SEQR review.
The board closed the public hearing at 8:02 p.m. and completed Part II of the SEQR form; it then voted to declare a negative declaration. The Planning Board approved the site plan with conditions that must be met prior to issuing a building permit, including submission of final site plans and a final SWPPP signed by a New York State professional engineer, demonstration of SPDES Construction General Permit coverage, submission of all required state and federal permits, acceptance by the Town Board of the decommissioning plan and financial surety, a $100,000 landscape maintenance surety for 10 years (escrowed and increased 2% annually), a construction logistics plan to address traffic, dust and road impacts, and pre‑operation coordination and training meetings with the Fort Edward Fire District. The motion to approve carried unanimously among voting members present.
