Council approves revised amphitheater access work after split votes; seating and theater construction excluded

Red Lion Borough voted to proceed with a revised DCED grant scope focused on ADA access and pathway revisions rather than constructing an amphitheater or seating. The revised scope will fund two ADA parking spaces, a curb cut and an ADA-compliant switchback pathway extending toward the splash pad and gazebo; it will not pay for seating, seeding or theater improvements.
The vote was contentious. Council member Brady Greer moved to reject the revised scope; the motion initially resulted in a tie that Mayor Lau broke to defeat the motion. A subsequent motion by Mark Holloway to approve the revised scope also resulted in a tie that Mayor Lau broke in favor, so the project will move forward under the limited scope. Council noted there is more than $200,000 in DCED grant funds available for the approved elements and that no local match is required.
Council also discussed returning $37,500 to ROARS (previously used for amphitheater design) and asked the solicitor to review invoices and the grant language to determine whether the Borough is obligated to return the funds.
