He argued the deck would be largely hidden from public view: "So really won't be visible to literally anyone else in the city," he said. Several residents, the city manager and the mayor questioned whether existing rooftop features on nearby houses exploited a code interpretation and warned that routinely allowing rooftop decks could change the city’s skyline.
The board reviewed the variance criteria and, following public comment and staff input that the code generally prohibits decks above the highest livable floor, members moved to deny the variance. The motion to deny carried on roll call. The board flagged code-interpretation issues that the planning department and council may wish to review for future guidance.
