County clerk authorized to destroy expired ballots under KSA 25-2708(b) with bipartisan oversight

County Clerk Bobby Dryling told the commission he periodically destroys ballots that have passed the statutory retention period and sought the commission’s authorization and appointment of bipartisan overseers to witness the destruction.
"The county clerk shall destroy ballots that are, within that time frame, and that is being for the general and or primary elections. I need to destroy those after 22 months," Dryling said, citing KSA 25-2708(b). He asked the commission to authorize destruction of the 2024 presidential preference primary ballots, the 2024 primary election ballots, and the 2025 general city/school election ballots and to appoint Eugene Rupp and Mike Weber to oversee the process.
A commissioner moved to allow the county clerk to destroy the listed ballots and appointed the two overseers; the motion passed by voice vote. Dryling said he will schedule destruction at the landfill and record the process in the minutes.
