Nevada Board of Pharmacy adopts several regulations adding drugs to Schedule I and updating facility licensing

The board unanimously adopted multiple LCB-filed regulations Dec. 4 that revise licensing for narcotics-treatment facilities, amend NAC 639 for skilled nursing/intermediate care facilities, and add several substances (including fentanyl-related compounds) to Schedule I.
The Nevada State Board of Pharmacy adopted several proposed regulations during its Dec. 4 session, including LCB File Nos. R197-24, R203-24 and R204-24, and a workshop item to add dipentylone and multiple fentanyl-related substances to Schedule I. Board staff presented the proposals (General Counsel Brett Kandt, Executive Secretary David Wuest and Grant Analyst Darla Zarley), and the board adopted the measures unanimously after brief discussion and little or no public comment.
One adopted item, LCB File No. R197-24, revises licensing requirements for facilities that provide treatment with narcotics. Another (R203-24) amends NAC 639 to align licensing requirements for facilities for intermediate care and skilled nursing licensed by the State Board of Health. The board also adopted additions to Schedule I, including ethylphenidate and 2-methyl AP-237 (LCB File No. R204-24), and approved adding dipentylone and seven fentanyl-related substances via staff presentation in the regulatory workshop. The minutes record no substantive opposing public testimony for these items; the board voted to adopt the files as presented.
Board staff noted that any public comments received on workshop items had been shared with members before the vote. These regulatory changes become part of the Nevada Administrative Code and will be subject to the standard administrative effective dates and implementation procedures recorded in the formal LCB filings.
