After more than an hour of testimony, legal review and public comment, Avalon City Council voted 3–2 to take no further action on a proposal to broaden the city’s medical-delivery cannabis ordinance to allow adult‑use recreational delivery.
Staff reviewed prior ballot results (2020 advisory measures where a majority voted no) and raised legal questions about transporting recreational cannabis to the island. Representatives from the local delivery operator ERBA (Elizabeth Wenger and Alex, speakers 4 and 27) proposed a development agreement and initially offered 5% of gross receipts to the city — "we're definitely willing to up to up to 7 to 10% as well," an applicant said during the presentation. Councilmembers and hotel operators cited enforcement, smoke-control and community expectations; several members argued that allowing adult use without fresh voter input would circumvent past electorate decisions. The motion to take no further action preserves the existing medical-delivery permit and allows proponents to pursue a ballot path if they choose.
