The Unified Government of Cusseta–Chattahoochee County Commission on Dec. 3 denied a Conditional Use Permit (CUP) that would have allowed the Lopez family to place a new manufactured home at 105 Mustang Drive. Vice‑Chairman Timothy Biddle moved to deny the permit; Commissioner Gerald Douglas seconded, and the motion passed unanimously.
The public hearing drew multiple neighbors who said the street is predominantly stick‑built homes and that allowing a new manufactured home would harm neighborhood character and property values. Chairman Charles Coffey noted for the record that "we have 44 signatures against this" and cited the petition as a factor in the decision. Neighbors also said existing manufactured homes were grandfathered in and that no new ones have been added in over 20 years.
Applicant Janet Lopez told the commission she purchased the one‑acre lot to be near family and said she needed to replace a 1990 mobile home she described as having black mold so she could "support her family"; the record notes the household includes a teenager and a newborn. Planning & Zoning had recommended approval before the hearing; several neighbors, including Matt McAdams and Melissa Haymond, challenged whether the request met the ordinance conditions in Appendix A.3 on preowned manufactured homes.

Commissioner Jason Frost and Vice‑Chairman Biddle said the county should review and possibly amend the CUP rules to reduce recurring neighborhood disputes. The county attorney advised that any change in procedure would still require the formal public‑hearing process.
