The Town of Walworth Planning Board voted unanimously July 13 to approve a five‑lot subdivision and site plan for a vacant 3.71‑acre parcel at the intersection of Mildahn Road and Gananda Parkway, clearing the way for five single‑family homes.
The Board, which acted as lead agency under the New York State Environmental Quality Review Act, issued a negative declaration after finding no significant adverse environmental impacts. Don Lewis of D.H. Lewis Engineering, speaking for the applicant Double R Custom Homes, told the Board the design team "have been working with the water authority on water and sewer dimensions along with the health department," and that they will provide easement descriptions and MS4 SWPPP forms for review.
The resolution grants preliminary and final subdivision approval and site plan approval subject to conditions. The Board required legal access agreements for the flag lots and that the form and maintenance of access be reviewed and approved by the Town Attorney; confirmed that access must meet New York State Fire Code to the satisfaction of the Town Fire Marshal; and required the applicant to address outstanding Town engineer and code enforcement comments before signatures may be affixed to the final plat. The resolution also finds that a suitable park cannot be located on the subject lands and requires a fee in lieu of parkland per lot under Town Law Section 277, to be paid according to the Town of Walworth Fee Schedule.
Other conditions include submission of necessary easements for public improvements/utilities, posting performance security as required by Town Code (Section 151‑7), completion of any required utility districting, obtaining permits from other governmental agencies (including WCWSA for sewer and water), and filing the subdivision plat with the County Clerk. The motion to approve the resolution was offered and seconded by board members and passed on a roll‑call vote: Chairperson Landry, Lou Villanova, Kristen Rush and Doug Flye all voting "Aye."
