Magistrate finds Midwest Decoration Company in violation; 60-day compliance deadline set

At a formal code-compliance hearing for case 20240733, Code Compliance Manager Michael Hauserman presented a sequence of exhibits documenting inspections and notices related to 146 Hercules Drive, owned by Midwest Decoration Company. Hauserman said the initial complaint came via a FEMA list and that inspections and notices spanned from Oct. 15, 2025 through May 2026; he entered notice-of-violation and affidavit materials into evidence.
"And we would move that the respondents we found in violation of the code section cited, be given 60 days of which to come into compliance or a fine of $250 a day thereafter and court cost of $250 a day," Hauserman told the magistrate. After reviewing the record, Magistrate John Van Lehi set the compliance date 60 days from the hearing — Oct. 5, 2026 — and said fines would begin Oct. 6 at $250 per day if compliance is not achieved; a status review was scheduled for Nov. 3. The magistrate cited remodeling beyond the scope of expired permit 234613 and floodplain deficiencies as the bases for the order.
