Board approves multiple variances for Pequot Lakes property, staff says septic placement improves

The Planning Commission Board of Adjustment approved multiple setback variances Nov. 20 for property owned by the Sean Kirkpatrick Trust at 8421 North Clamshell Lane in Pequot Lakes (Ideal Township). Staff read requests for road right‑of‑way and several lake‑setback variances to allow an expanded garage, covered patio and dwelling additions, and to install a new Type 1 septic system.

Agent Dan Worley (Live4 Architecture) described the need to expand the garage (current low clearance does not accommodate vehicles), to relocate and improve the entry and to modify a lakeside covered patio that is largely existing. Staff and the agent emphasized the septic work would improve water‑quality outcomes by moving the new drain field further from the lake than the existing drain field; staff noted the drain field would be about 40 feet from the lake (state standard for a general development lake is 50 feet; Crow Wing County setback for structures is 75 feet).

One neighbor (Michael Valley) asked whether a 40‑foot drain field posed safety or water‑quality risks compared with 50 feet; staff explained drain fields require a three‑foot separation from seasonal high water and that properly constructed systems and required separations allow treated effluent to return to the environment safely. After reviewing conditions and findings, the board moved and seconded approval of the variances; the motion carried by voice vote. Applicants were reminded they must submit permit applications to Land Services before construction begins.
