Council discloses failed mediation on Pound Hill quarry; directs counsel to proceed to court

The council disclosed after an executive session that mediation over the Pound Hill Realty LLC dispute did not produce agreement and that it has instructed town counsel to end mediation and pursue the pending court case. "So we were unable to come to an agreement on the mediation. So we have instructed Robenheimer to cease all mediation discussions and move forward with the court case," the council announced after returning to open session.
Before the executive session, a resident submitted nine detailed questions about the proposed memorandum of understanding (MOU), read into the record by David Panchak on behalf of Jason A. Richer. The questions asked whether the MOU would effectively legalize a 32-acre expansion, whether it limits blasting, hours, dust and fugitive crystalline silica, and what enforceable measures protect the sole-source aquifer and nearby private wells from PFAS and other industrial impacts. The council did not answer those specific technical questions in open session and said legal strategy would be handled in executive session.
