Committee defers HP 18‑48 after debate over early water consultation

The House Committee on Water & Land deferred HP 18‑48 after extended discussion about whether district boundary amendment petitions should be required to include a statement documenting consultation with the Commission on Water Resource Management (CWRM). Chair Mark Ashram opened the hearing by explaining time constraints for testimony.
Kira Kahane, deputy director at CWRM, said the agency appreciates the bill's intent and recommended technical language changes to make the petitioner — not the commission — responsible for submitting a consultation statement. "We're not going to be able to say with a 100% absolute certainty what the availability of water is, but we can offer information based on the current sustainable yield and current withdrawals in the hydrologic unit," Kahane told the committee.
Scott Derickson, chief planner for the State Land Use Commission, urged that earlier input from water experts would help avoid costly planning dead‑ends, saying consultation earlier in the process will "help ensure that those expectations are clear early on and that alternatives can be explored before the project is fully planned out and vetted."
Members pressed witnesses about the Land Use Commission’s prior treatment of similar proposals. Derickson acknowledged LUC discussions and said the commission had not been unanimous when similar rule changes were considered. The chair noted the LUC would take up related items on its agenda and recommended deferral. The committee recorded the chair’s recommendation to defer HP 18‑48, saying the LUC and the committee should not be at odds over a process that the commission has considered multiple times.
