The council voted to vacate a 30-foot landscape buffer easement on Lot 5 of Scenic Point as part of the Culver's project. Planning staff explained the landscape buffer was planted in 2005 and that current zoning no longer requires the buffer in that location. Staff recommended approval of vacating the shaded area to avoid delaying the site's plan review.
Council asked clarifying questions about remaining buffer areas adjacent to homes and confirmed a six-foot fence requirement on the side backing up to residences. After closing the public hearing the council adopted a resolution to vacate the easement by roll call.
Staff said the remaining landscape buffer on the west side of the lot (adjacent to residences) will remain and include a privacy fence. The council's action clears the specific easement area identified in the application.
