Citing the prior violation, staff recommended a higher base penalty and Leach imposed a $500 penalty, suspending $150 provided Burke pays the unsuspended portion within 30 days, files the missing F1 within that same period, and has no further violations for four years.
Staff noted Burke did not respond to the hearing notice nor provide information to PDC staff. The chair directed staff to issue the written order specifying payment and filing deadlines; the matter will be tracked by PDC enforcement staff for compliance.
