PDC staff briefs commission on F‑1 reporting modification authority

Jennifer Hansen, the commission’s compliance officer, gave a brief presentation at the May 1 adjudicative hearing explaining reporting‑modification requests for personal financial affairs (F‑1) statements and the statutory authority the commission may rely on.
Hansen told the commission that "the commission has the authority to exempt, a filer from any portion of their of the filing requirements under their law, which is 42 17 a or their WAC 3 90." She added that the most common modification requests the commission sees relate to F‑1 filings. The staff presentation prefaced a later agenda item in which the commission considered and granted a partial exemption for Clay Norris.
The presentation was procedural and designed to put the Clay Norris request and similar petitions in the context of RCW 42.17A and the commission’s WAC rules; staff said it can consider hardship, impracticability and privacy concerns when evaluating requests and will document factual findings in written orders.
