PDC staff said Michael Bruce had not filed a C1 by the May 23 deadline and recommended a penalty under the WAC for a filer with no prior violations. Bruce told the commission he had been severely ill and hospitalized beginning about May 14 and that he had been transferred home the night before the hearing. "I have terminal stage 5 kidney failure," he said, describing his incapacity and explaining that the missed filing was not intentional.
Chair Jay Leach found the violation proven, imposed a $250 penalty and suspended the entire amount on the conditions that Bruce file the C1 within 15 days of the hearing and have no further violations for four years. The chair also expressed well-wishes to Bruce and noted staff would assist with compliance and electronic payment options.
