Douglasville council denies claim filed under OCGA 36-33-5 (item 26-265)
Summary
The council unanimously denied a claim identified on the agenda as item 26-265 (a claim submitted by the party named in the agenda) after a motion to deny 'as presented.' City staff said the item was back on the agenda because the prior Thursday action required additional procedural handling.

Council considered item 26-265, described on the agenda as a claim submitted pursuant to an anti-litem notice under OCGA 36-33-5. Finance Committee chair Chris Watts moved "that the claim be denied as presented." After a second and a voice vote, the mayor declared the ayes have it and announced item 26-265 was denied.
City Manager Marcia Frazier and legal counsel Joel Dodson were present for procedural clarification. Frazier told the council that the items were before the body again because, although action had been taken at Thursday's work session, the procedure had not been handled in the appropriate manner and required this council action tonight. No appeal or further motion was recorded on the transcript.
