Willard City Council reviewed and conditionally approved the rezone and development agreement for The Orchards MPZ on Aug. 14. Developer Garth Day attended the meeting and confirmed the development has "approximately 200 acre-feet of water available, with only about 50 acre-feet needed for the development," a surplus the council said should be negotiated with the city.
Council discussion focused on multiple terms in the agreement: the development will not meet the 20% open-space requirement internally and will therefore provide a fee in lieu of open space with an appraisal to value the shortfall; proposed language for a secondary-water company raised questions about long-term maintenance and integration with any city-wide secondary system, and council asked staff to revise the agreement language to preserve city interests. A motion to approve the rezone and development agreement passed contingent upon the mayor and staff finalizing the revised secondary-water language and approving attachments.
