Millcreek's City Council unanimously approved Ordinance 26-20 on April 27 to correct and clarify Exhibit C of the development agreement for Villa Vista Townhomes so that live/work units are required only in Building 1, consistent with the approved site plan.
Planner Carlos Estudillo told the council the recorded agreement inadvertently required live/work units in Building 2; the amendment revises the language to reflect the applicant's intent that such units be solely in Building 1. Council Member Thom DeSirant moved to approve the ordinance; Council Member Silvia Catten seconded and the Recorder called the vote, which passed 5–0.
Why it matters: the change is administrative and aligns the legal agreement with the project's approved design without altering the project's overall scope. Staff and the applicant said the amendment removes ambiguity and avoids imposing an unintended commercial requirement on Building 2.
