The Middletown Common Council unanimously approved a resolution authorizing a proposed settlement in the matter of Medical Development Associates, LLC v. City of Middletown, docket number MMXCV236036895S, and authorized the mayor to sign the agreement subject to review by the Office of General Counsel. "Resolution approving the proposed settlement in the matter of Medical Development Associates LLC versus City of Middletown at MMXCV236036895S," Councilman Nocera read to the body before the voice vote.
The council moved into a closed executive session to consider information and possible settlement options earlier in the meeting; the chair said recording and microphones would be turned off for that session. Upon returning to public session at 5:49 p.m., Councilman Nocera made the motion to approve the settlement, it was seconded, and the council voted "aye" with the item recorded as passing unanimously. The resolution authorizes Mayor Benjamin D. Florsheim to execute the agreement pending final form review by the city's Office of General Counsel.
