Resolution to appoint viewer for Toman Ranch Road fails after commissioners cite cost concerns

Public Works Director Gene Legurski outlined the statutory viewer process, the school district’s role as lead petitioner (the district would pay the $1,500 mailing fee), and said a viewer’s report historically costs around $8,500.
Commissioners questioned the merits of the study given budget pressures, potential ongoing maintenance liability if the county assumed the road, and uncertainty about how many non-school users would benefit. “For $8,500, that's a big ask for my opinion,” Chairman West said during the discussion, noting that the road serves only a few students and that long-term maintenance obligations could be significant.
Commissioner Slaughter and others echoed budgetary concerns. The board conducted a roll-call vote: the resolution failed 4 to 0, with Commissioner Toman recorded as abstaining. Legurski noted Lincoln County is taking parallel action and that the counties hope to coordinate so one viewer’s report can serve both jurisdictions if the process proceeds in the future.
Because the resolution failed, the earlier, separate resolution from 2023 remains unaffected; Legurski said he would bring a clarification resolution later if needed.
