Petitioner counsel Jay Cancel disputed the significance of some items found and argued improvements had been made, saying signs were down and the parking lot had been cleaned.
Board members and staff debated whether remaining items on shelves were the kinds of things contemplated by the condition; staff maintained condition 4 prohibits certain lighters, steel scrubbing pads and other items commonly linked to paraphernalia. After discussion the board moved to uphold the BPS revocation of the conditional‑use permit; the motion passed in open session.
