Hearing officer recommends zoning change to align Huachuca City home-business rules with state firearms law

Hearing Officer Dr. Johnson opened a public hearing Feb. 19 in Huachuca City to present proposed text amendments to Section 18.100.210 D(1) of the town zoning code intended to align local restrictions on home-based businesses with state law. "I'm doctor Johnson, this town's hearing officer. The amendment is necessary to align the town code section 18.100.210 D (1) with state law concerning firearm related home based businesses and to further clarify what is prohibited," he said.
Dr. Johnson read the draft amendment aloud for the record. The proposed language includes the following prohibition: "The operation of a home based business involving the sale, mail order, trade, manufacture, display, storage or repair of any sort of explosive or improvised explosive device, and or prohibited weapons, as defined under ARS Section 13-3101." The hearing officer told the chamber the amendment text and a handout were posted for public review and that highlighted text indicated deletions while red text indicated additions.
No written comments or phone-in comments had been submitted before the hearing, Dr. Johnson said, and no members of the public spoke during the open-comment period; he noted only three people were present in the chamber โ himself, Town Clerk Brandye Thorpe and Chief of Police Wyatt Barry. After a brief wait for any arrivals, Dr. Johnson closed the public hearing.
Following the close of the hearing, Dr. Johnson announced his formal recommendation: "It is my recommendation to approve the amendment as written. This will be sent on to the Council for them to make the final reading." The Town Council is scheduled to consider the hearing officer's recommendation at a future meeting; no Council vote occurred at the Feb. 19 hearing.
The amendment references Arizona Revised Statutes definitions in ARS Section 13-3101. The hearing minutes were later certified by Town Clerk Brandye Thorpe and approved by Mayor Johann R. Wallace on Feb. 26, 2026.
