Commission backs fee-in-lieu mitigation for one project but requires extinguishment of purchased credits

The commission reviewed a fee-in-lieu request tied to the city’s Growth Management Quota System (GMQS) and the affordable-housing credit market. Staff said the applicant had already secured 0.46 FTEs using the credit system but still needed 0.65 (staff later noted an updated estimate of about 0.96 FTEs). The applicant asked to pay the remaining amount—roughly 0.19 FTEs—by fee-in-lieu so their permit could proceed.
Haley Hart explained the rationale for the city's 2024 policy allowing fee-in-lieu when credits are not reasonably available, saying staff tracks the market and that credits are often withheld by certificate holders. “It is not our best interest nor is it good customer service to hold up building permits because of the lack of availability in the free market,” Hart said. Commissioners expressed concern that permitting payment in lieu could undermine the intent of the credits program if owners could retain credits for other projects; one commissioner said, “I don't love that option.”
Commissioners debated language and then amended the recommendation to require that the applicant extinguish (surrender) the 0.46 credits already purchased as a condition of the recommendation to city council and require that extinguishment happen prior to building-permit issuance. The amended recommendation—clarifying the site-specific nature of the allowance and the extinguishment requirement—passed by roll call. The matter will be presented to city council for final approval.
