Counselor Boswell told the board the statute for school-board candidates appears to address party affiliation differently than the general rule for other offices: "The statute suggests that you're only challenging the affiliation, not the entire candidacy," Boswell said, but he added that the election division's guidance appears to remove the entire candidacy if a party-affiliation challenge is sustained.
Board members asked about filing and ballot timelines; Director Becker said she believed a relevant filing deadline was Aug. 3, while other participants referenced Aug. 21 and the Aug. 21–28 write-in window. Counsel and staff warned the board that decisions could be subject to quick judicial review and recommended building a clear administrative record before adjudicating the challenges. A board member moved to table the IPS District 4 challenge pending further clarification; the motion was seconded and the board carried the motion by voice vote.
Counsel recommended consolidating hearings for both challenges and invited written materials to staff to support adjudication. The board instructed staff to seek guidance from the state election division and to schedule a follow-up hearing once the legal and timing questions are clarified.
